Just WHO is Reading Your Email?

Recent tech-blogs have been debating the issue of privilege and confidentiality due to  the terms of service that Google imposes on the users of the free version of Gmail.  Because Google “reads” the content of each email in order to deliver targeted advertising to the readers, this could constitute the dissemination of attorney-client privileged (“ACP”) material, thus waiving the attorney-client privilege.  Furthermore, such dissemination could be a violation of the ABA Model Rules of Professional Conduct.[1] Numerous issues regarding privacy and privilege are therefore implicated and worthy of discussion. Part 4 in Our “Go Virtual With Law Clerk Connection” Series

Sitting in waiting rooms.  Sitting in traffic.  Sitting in airports.  Standing in line waiting. Waiting to pick up your kids from one of their myriad of activities.  In our modern world so much of our time is spent just waiting.

However, smart lawyers have hooked up with some new technology to put this down time waiting to full-time use.  Let me give you an example:

Sam is multi-tasking while driving, using his hands-free headset, and talks to a client, Nancy, to nail down the answers to three questions.  He gets all the answers he needs and finishes up his call.  But now he needs to remember to email a document to Mike, his virtual Law Clerk when he logs onto his laptop, and ask him to check on prior cases in a certain state, and he needs to remember to record his talk time for billing purposes. Improving Access To Legal Services

The economy may be in a recession, but that doesn’t mean that injustice is. Everyday, thousands of individuals are left without a voice because they do not have access to legal aid. Despite a recent influx of over $40 million in federal funding to legal aid providers, those providers are only able to assist approximately one-half of the eligible clients seeking their help.

Law Clerk Connection hopes to improve this dismal statistic by partnering with non-profit organizations, pro-bono attorneys and low/no-cost legal services attorneys. (more…)
